
Colombia's Television National Authority (ANTV) issued the law that regulates the implementation of access systems for the hearing impaired in contents broadcast through the public television service.
Taking into account the rights of the deaf and hypoacusic population and ANTV's role as regulator of the public television service, Ruling 350/2016 was issued. It compels concessionaires of television spaces at Canal Uno, open television operators with national, regional and local coverage, as well as paid television operators with self-produced programming to implement systems that guarantee access to television for this population.
Background:
Between 2003 and 2012 the National Television Commission (now ANTV) issued a series of resolutions and agreements that were aimed at determining compliance dates and regulate the implementation of access systems such as closed captioning and Colombian sign language. Towards 2011, through an appeal sentence, it was considered that the ICT Ministry and the former CNTV should regulate the issue, since the objectives and purposes that the Constitution and the law determined in order to protect the deaf population were not guaranteed effectively.
ANTV continued adjusting the regulation based on research, documents and properly supported regulatory projects as well as observations, concerns and comments received, which have been included based on their relevance. It also took into account more than 12 international experiences in which the legal frameworks and mechanisms used for the implementation were analyzed.
This new resolution includes information, promotion and implementation measures as well as a punitive regime applied through fines, service suspension, grant expiration or license cancellation.
